To Elect a Chairman for this meeting only.

Minutes:

RESOLVED that Councillor Milne be elected Chairman of the Regulatory Sub-Committee for this meeting only.

 

Councillor Milne took the Chair for the remainder of the meeting and round the table introductions were made.

Members Declarations of Interest

Members may make any declarations of interest at this point but may also make them at any time during the course of the meeting.

Minutes:

All Members present declared that they had sat on a Regulatory Panel that considered a previous case concerning the applicant, and were familiar with some of the history of the case.

The Following Item(s) will be dealt with in accordance with the Principles of Natural Justice adopted by the Council.

Note 1

This licensing authority will only allow licensing decisions to be taken by a minimum of three Councillors.  In the event of one member being unable to attend, their place will be substituted by another member.  In the event of this substitution taking place all parties will be informed of the change of membership at the beginning of the hearing.

 

Minutes:

The Chairman welcomed all present to the meeting. The Principles of Natural Justice were to be followed, and the procedure attached to the agenda pack was repeated to those present.

Exclusion of Public and Press

To resolve that under Section 100 (A)(4) of the Local Government Act 1972, the public and press be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12A of the Act.

 

Minutes:

RESOLVED that under Section 100(A)(4) of the Local Government Act 1972, the public and press be excluded from the meeting  for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12A of the Local Government Act 1972 – Information relating to an individual.

5.

The renewal of a Hackney Carriage/Private Hire Drivers Licence

Minutes:

Members considered a report on the renewal of a Hackney Carriage/Private Hire Drivers’ Licence.

 

The Licensing Manager introduced the report and asked Members to consider whether the applicant was a fit and proper person to be carrying passengers?

 

The Police outlined their case against the applicant to Members, citing information that they had compiled.  At various points in proceedings, the Legal representative present asked the officers from the Police to clarify certain points they had made.

 

Questions were posed of the Police, the Licensing Manager and the Legal representative by the Panel members. 

 

Note:  The meeting adjourned at 1328 to allow Members to reach a decision in private.

 

Note:   The meeting reconvened at 1344.

 

RESOLVED to refuse the application for renewal of a Hackney Carriage/Private Hire licence, for the reasons outlined in the decision notice.
